Terms of Service

These Terms of Service ("Terms") govern your use of the JollyTango mobile application ("Service") provided by Aarsh Innovations LLC ("we," "us," or "our"), based in New Jersey, United States. By clicking "Get Started" or using the Service, you agree to these Terms.

1. Definitions

• Service – The JollyTango app and all features, modes, and content.
• Pass – A time-limited license to access Premium features (e.g., 24-Hour Pass, 3-Day Pass).
• Content – Narrations, text, audio, trivia, or other information provided through the Service.
• Third-Party Content – Data, photos, news, or other materials provided by third-party APIs or services.

2. Eligibility

You must be at least 13 years old to use the Service. If you are 13–17 years old, you may use the Service only with parental or guardian consent. In the EU, UK, or regions with higher thresholds, you must be at least 16 years old (or the local minimum digital consent age, not lower than 13).

3. Service Description

JollyTango provides travel narrations, stories, and information generated from a combination of proprietary content, licensed data sources, and automated technologies.

• Air Mode – Real-time flight tracking and related information.
• Land Mode – GPS-based stories, weather, and local information.
• Ocean Mode – Vessel tracking and maritime-related information.

Other features include: weather overlays, photos, news, Daily Trivia (one play per day), and games (e.g., Chess, Sudoku).

Passes: Basic Pass – 2 daily updates. Premium Pass – unlimited updates, narration focus, weather layers, and expanded features.

4. User Accounts

Anonymous authentication assigns a random, non-identifiable ID. Purchases are tied to your Apple ID or Google Account via RevenueCat. Account recovery is not possible if you lose access to your Apple/Google account.

5. Purchases and Subscriptions

Passes are sold via Apple App Store and Google Play. Refunds follow Apple/Google policies.

6. Content and Accuracy

Content may vary, be incomplete, or contain inaccuracies. Do not rely on Content for navigation, safety, or emergency purposes. Third-Party Content is the responsibility of its providers.

7. Acceptable Use

• Do not use the Service for unlawful purposes.
• Do not reverse engineer, tamper with, or disrupt the Service.
• Do not spoof location data or manipulate algorithms.
• Do not redistribute or commercialize Service content without permission.

8. Intellectual Property

All Service content, code, and features are owned by us; certain features are patent pending. Providing feedback grants us a non-exclusive, royalty-free, perpetual license to use it for improvements. "JollyTango" is a trademark of Aarsh Innovations LLC.

10. Disclaimers

• The Service is provided "as is."
• Availability depends on third-party APIs and connectivity.
• We aim for high uptime but cannot guarantee it.
• The Service is not a substitute for emergency services. Always dial local emergency numbers.

11. Limitation of Liability

To the extent permitted by law, we disclaim all warranties (express or implied) and are not liable for indirect or consequential damages. Our total liability is capped at the amounts you paid in the preceding 12 months. Nothing excludes liability where prohibited by law.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or costs (including legal fees) arising from your misuse of the Service or violation of these Terms.

13. Dispute Resolution

U.S. users – Binding arbitration under AAA rules in New Jersey (unless eligible for small claims court). Class actions are not permitted. International users – Mandatory consumer protections in your country remain unaffected.

14. Termination and Suspension

• Suspension – Temporary restriction due to suspected violations or technical/security issues.
• Termination – Permanent end of access. No refunds for unused Pass time if terminated for violations.

15. Export Control

You may not use the Service in violation of U.S. export laws or international sanctions.

16. Force Majeure

We are not liable for delays caused by circumstances beyond our control (e.g., API outages, internet failures).

17. Accessibility

We aim to comply with WCAG 2.1 standards but cannot guarantee compatibility with all assistive technologies.

18. Severability

If any provision is unenforceable, the remaining provisions remain effective.

19. Waiver

Failure to enforce any right does not constitute a waiver.

20. Assignment

You may not assign rights; we may assign in connection with a merger, acquisition, or sale.

21. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us.
